Frequently Asked Questions

Is there a time limit for bringing a lawsuit?

Yes. Injury claims have a statute of limitations deadline by which they must be filed. Failure to meet the filing deadline could lead to the dismissal of the claim, and therefore an inability to recover damages. In Montana, the general statute of limitations for personal injury claims is three years from the date of injury, but some facts and circumstances can either shorten or lengthen this time period.

The insurer wants to settle my claim. Should I engage with them?

Insurance companies are not your friends. Their interests are in direct opposition to yours. Moreover, any statements you make regarding your circumstances or the facts of your case  could be used to undermine your claim. If an insurer is attempting to engage with you, do not engage back. Contact an attorney immediately. Your attorney will serve as the point of contact, ensuring that all communications are guided towards a resolution that is favorable to your interests.

How do contingency fees work for personal injury cases?

Most personal injury firms (including our own) work on a contingency fee, which is a percentage fee paid out of the total monies recovered for you. A contingency fee is paid only if you obtain compensation. This fee arrangement incentivizes  the law firm to secure a “win” on your behalf. If you do not obtain any compensation, you will not have to pay your attorneya fee.

Why is it important to work with an injury attorney early on in the claim process?

The earlier you secure the assistance of an attorney, the better. An attorney will ensure that your claims are properly evaluated and filed within the statute of limitations deadline, and that all necessary procedural requirements are met. Further, the attorney will begin the investigation process and reach out to witnesses in a timely fashion to secure the evidence and  testimony that supports your case.
